The UK Government acted illegally in its implementation of Article 7(1) of the Working Time Regulations. The UK Regulations gave the right to paid holiday only after an employee had worked for the employer for 13 weeks. The right to paid holiday now arises on day one of employment and therefore applies to short term contract workers.The government could now face compensation claims estimated at £200 millions from those affected by its unlawful implementation of the European Directive between 2008 and 2010.
